Agreement to Terms

By accessing or using Quiet Quacker ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Description of Service

Quiet Quacker is a web application that enables hosts to create sessions and receive audible alerts from participants who join using a short code. The Service is provided on an "as is" and "as available" basis.

User Accounts

You may use the Service as a guest with limited session duration (15 minutes), or create an account for extended access. When you create an account, you are responsible for maintaining the security of your account credentials. You agree to accept responsibility for all activities that occur under your account.

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm another person or group
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to the Service
  • Use the Service for any purpose that is harmful, fraudulent, or otherwise objectionable
  • Abuse the signaling functionality to spam or harass hosts

Session Data

Sessions are temporary and automatically expire after 24 hours. We do not guarantee the persistence of any session data beyond this period. The Service may delete expired sessions at any time without notice.

Microphone Access

Certain features of the Service (decibel monitoring) require access to your device's microphone. This audio data is processed locally on your device and is not transmitted to our servers. You may revoke microphone access at any time through your browser settings.

Intellectual Property

The Service and its original content, features, and functionality are owned by Quiet Quacker and are protected by international copyright, trademark, and other intellectual property laws.

Limitation of Liability

In no event shall Quiet Quacker, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

Specifically, Quiet Quacker is not responsible for:

  • Failures of audible alerts to play due to browser restrictions, device settings, or volume levels.
  • Network latency or interruptions that delay signal delivery.
  • Any consequences or damages resulting from missed alerts or system downtime.

The Service is a signaling tool and should not be relied upon for critical or life-safety applications.

Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We make no warranty regarding the accuracy, reliability, or completeness of any information provided through the Service.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.
